SUMMARY:Digital Property Rights after the TomKabinet Decision of the CJEU: the Road to Digital Serfdom?
DESCRIPTION:Am 27.1.2021 fand die Zoom-Antrittsvorlesung unseres Alumnus Dr. Ioannis Revolidis an der Universität Malta statt\, die mit über 80 Teilnehmern sehr gut besucht war. Ioannis setzte sich dabei rechtlich mit der Frage des „digitalen Eigentums“ am Beispiel des EuGH-Urteils\, Rs. C-268/18 – Tom Kabinet auseinander. Da Urteil betraf im Wesentlichen die Frage\, inwieweit der Weiterverkauf von „gebrauchten“ E-Books gegen europäisches Urheberrecht verstößt oder durch den sog. Erschöpfungsgrundsatz gerechtfertigt werden kann. Anders als noch in seinem Urteil in der Rs. C-128/11 – UsedSoft wendete der EuGH im Fall Tom Kabinet den Erschöpfungsgrundsatz nicht an\, da der digitale Weiterverkauf von E-Books aus seiner Sicht eine „öffentliche Wiedergabe“ im Sinne der InfoSoc-RL darstelle\, für die der Erschöpfungsgrundsatz nicht gelte. Ferner sind gebrauchte E-Books aus Sicht des EuGH auch keine Software\, sodass sich Tom Kabinet auch nicht auf den Erschöpfungsgrundsatz in der Software-RL berufen könne. Ioannis Vortrag und die daran anschließende Diskussion\, betrafen die rechtlichen als auch sozialen Folgeimplikationen des EuGH-Urteils\, insbesondere auch im Hinblick auf die Grundfesten unserer demokratischen\, maßgeblich auf freien Informationszugang basierenden Gesellschaftsordnung.
